1. Acceptance of Terms
By accessing or using Plan Your After LLC’s website, services, and estate planning document generation tools (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Plan Your After LLC, a limited liability company organized under the laws of the State of Washington (“Company,” “we,” “us,” or “our”).
2. Description of Service
Plan Your After provides an automated, self-help software platform that enables users to create estate planning documents, including but not limited to revocable living trusts, last wills and testaments, powers of attorney, healthcare directives, and HIPAA authorizations.
IMPORTANT: WE ARE NOT A LAW FIRM AND DO NOT PROVIDE LEGAL ADVICE.
The Service is designed for informational and self-help purposes only. Our document templates are created based on general legal principles and may not address every legal requirement in your specific jurisdiction or account for your unique circumstances. The purchase and use of the Service does not create an attorney-client relationship between you and Plan Your After LLC.
We strongly encourage all users to have their completed documents reviewed by a licensed attorney in their state of residence before signing or relying upon them. Estate planning laws vary significantly by state and change frequently. Only a licensed attorney can provide legal advice tailored to your specific situation.
3. User Responsibilities
By using the Service, you acknowledge and agree that:
- You are responsible for providing accurate, complete, and current information when creating your documents.
- You understand that the documents generated are based solely on the information you provide.
- You are responsible for reviewing all generated documents for accuracy before signing.
- You understand that proper execution (signing, witnessing, notarization) requirements vary by state and document type, and you are solely responsible for ensuring proper execution.
- You are responsible for determining whether the documents meet your specific legal needs.
- You will not use the Service for any unlawful purpose or to create documents with fraudulent intent.
- You are at least 18 years of age and have the legal capacity to enter into contracts.
4. Account Registration and Security
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete registration information.
- Maintain and promptly update your account information.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
5. Fees and Payment
The Service is offered as displayed at the time of purchase. Creating an account and drafting documents in preview mode is free of charge; in preview mode, portions of document text are withheld and downloads are not available. Currently, a one-time payment of $149 (U.S. dollars) unlocks the complete estate planning package — the full text and download of all six documents — and includes the first year of full access with unlimited changes. After the first year, access continues at $19 per year (U.S. dollars), which auto-renews and includes unlimited changes and guided life-event updates. You may cancel your subscription at any time.
Refund Policy: Due to the digital nature of the Service and the immediate delivery of document generation capabilities, all sales are final. If you experience technical difficulties preventing you from using the Service, please contact us at support@planyourafter.com, and we will work to resolve the issue or, at our sole discretion, may offer a refund.
We reserve the right to change our pricing at any time. Any price changes will not affect purchases already completed.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The documents generated will be legally enforceable or appropriate for your specific situation or jurisdiction.
- The Service will meet your requirements or expectations.
- The Service will be uninterrupted, timely, secure, or error-free.
- The information provided through the Service is accurate, complete, or current.
- Any defects in the Service will be corrected.
You acknowledge that the legal validity of any document depends on many factors, including but not limited to state law requirements, proper execution, and your specific circumstances. We make no representation that any document will achieve any particular legal outcome.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLAN YOUR AFTER LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or use
- Costs of procuring substitute services
- Legal costs or fees incurred due to document invalidity
- Tax consequences or penalties
- Estate administration costs or delays
- Family disputes or litigation
- Any other damages arising from your use of or inability to use the Service
This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Indemnification
You agree to indemnify, defend, and hold harmless Plan Your After LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; (d) the content of any documents you create using the Service; or (e) the execution, use, or legal effect of any documents created through the Service.
9. Intellectual Property
The Service, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and document templates), is owned by Plan Your After LLC or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Upon payment, you are granted a limited, non-exclusive, non-transferable license to use the Service and the documents generated for your personal, non-commercial estate planning purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or publicly perform any portion of the Service except as expressly permitted by these Terms.
10. Prohibited Uses
You agree not to use the Service:
- To create documents on behalf of others for compensation without proper licensing
- To engage in the unauthorized practice of law
- To create documents with fraudulent, deceptive, or illegal intent
- To violate any applicable federal, state, local, or international law
- To infringe upon the rights of others
- To transmit any malicious code, viruses, or harmful components
- To attempt to gain unauthorized access to any portion of the Service
- To interfere with or disrupt the Service or servers connected to the Service
11. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.
Upon termination, your right to use the Service will immediately cease. You may download and retain copies of any documents you have created prior to termination. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue binding arbitration in King County, Washington, in accordance with the rules of the American Arbitration Association.
YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the “Last Updated” date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
We encourage you to review these Terms periodically for any changes. Changes are effective immediately upon posting.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Plan Your After LLC regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter of these Terms.
